Terms + Conditions

1. Applicability
The following business terms are applicable to all the contracts, which you conclude with us as a supplier (bergnerschmidt UG) via the www.bergnerschmidt.com website. By placing the order, the customer – hereinafter referred to as the purchaser – declares that he/she agrees with our terms and conditions. Any provisions to the contrary require our written consent.

2. Prices
Prices are stated in euros (EUR) and include the statutory Value Added Tax. The prices stated on the Internet pages on the date of receipt of order are valid.

3. Conclusion of the contract
The subject-matter of the contract is the selling of products.
The purchase agreement takes place via the online shopping cart system as follows:
3.1. The products intended for purchase are moved to the “shopping cart”. You can select the shopping cart using the appropriate buttons on the navigation bar and make changes there at any time.
3.2. After calling up the “NEXT STEP” page, entering the required personal data for the billing adress and if necessary, a different shipping address.
3.3. After choosing your shipping methode (DHL), you will be forwarded to the web page of the instant payment provider. (PAYPAL) choose and enter your details as appropriate. You will then be returned to the order summary page in our online shop.
3.4. Before the order is sent, you can re-check all the data, change it (which can also be done via the internet browser’s ‘back’ function) or cancel the purchase transaction.
3.5. By clicking the “PLACE ORDER” button to submit the order, you declare acceptance of the order in a legally binding way by which the purchase agreement takes place. The confirmation of receipt of order is issued by automated email together with the acceptance of the order immediately after dispatch. Consequently, you have to ensure that the e-mail address that you have deposited with us is the correct one, and that the receipt of the respective e-mails is guaranteed. In particular, you have to ensure that the respective e-mails are not blocked by a SPAM filter.

4. Delivery
Deliveries are made to the consignment address specified by the Purchaser. Orders are prepared ready for dispatch as soon as possible depending upon the date of receipt. Deliveries are normally dispatched as parcel consignments with DHL. The Purchaser can assume that the ordered goods will usually shipped within 5-7 office days after we received your payment, unless any other delivery period is indicated in the item description. If you have ordered several articles with different shipping dates, we will send the articles together in one delivery if no other agreement has been made. The shipping date for the complete order will be the same as of the article with the longest delivery time. Domestic delivery within Germany usually takes 1 – 2 office days, international deliveries usually take between 4-21 days. International orders may take longer due to customs formalities. If an item is not in stock, delivery can take up to 14 days or longer in exceptional cases. If an item is generally no longer available, the supplier reserves the right not to deliver these items because of non-availability. The Purchaser will be informed of this without delay.

5. Shipping costs
The shipping costs are calculated automatically for each order. Deliveries to other countries may incur different shipping costs, additional customs and other duties as well as taxes in the recipient country. These costs will be borne by the Purchaser.

6. Improvements and modifications
The supplier reserves the right to carry out product modifications for the purpose of improving quality, including without prior notice. There may be minor deviations from descriptions, colours and illustrations.

7. Handling of the material
the purchaser confirms to have read instruction manual by clicking 'MORE' at the item description to learn more about handling concrete jewellery and accessoiries. the buyer is aware of the fact that the surface of the product will change by using it.

8. Retention of title
The goods remain our property until the purchase price is paid in full.

9. Revocation right
You have the right to revoke this contract within fourteen days without specifying any reasons. In order to exercise your right of cancellation you must notify us clearly in writing of your decision to cancel this contract (e.g. a letter sent by post or email). In order to safeguard the revocation period, it is sufficient that you send the notification about the exercise of the revocation right before the expiry of the revocation period. If you wish to revoke the contract, please fill up this revocation form and send it back to us.

10. Data privacy
All data required for processing the business transaction is stored in accordance with the statutory provisions on data protection. The supplier takes all safety, technical and organisational measures to ensure comprehensive data security. In order to protect the user’s personal data, the supplier is obligated to comply with the right to self-determination concerning personal information. All personal data will be treated as absolutely confidential.

10.1. The user must acquaint themselves with the rules on data management described in the general terms and conditions of business. By issuing a binding order, the user agrees that the rules on data management form part of the general terms and conditions of business. The user declares that the decision to opt for management of his personal data has been made of its own free will and agrees to the rules on the management of its personal data.

10.2. For purchases in the Web shop the supplier will only manage the disclosed personal data on the user.

10.3. If the user cancels a purchase transaction, any personal data previously entered will not be saved. With the exception of the data for orders which have already been filled and which is stipulated in pertinent statutory provisions or tax law as a mandatory requirement regarding the statutory periods for data retention.

10.4. The provider will only manage the user’s personal name for the order, the handling of the purchase process and the billing, as well as for purposes of business communication.

The supplier gives an undertaking not to disclose the user’s data in any way whatsoever to unauthorized third parties and to protect this data from any unauthorized access. If the user wishes to receive newsletters about special offers or new products by email, its email address will be stored for this purpose. The newsletters are free of charge and can be cancelled at any time.

11. Copyright
All pages of the Shop are protected under copyright law. Reproduction in any form whatsoever constitutes a breach of copyright law and will be subject to criminal proceedings and render the person responsible liable to damages.
